Terms of Service

CarEKG is operated by EKG Diagnostics LLC, an Oregon limited liability company ("we," "us," or "our"). This app is an AI-assisted vehicle diagnostic tool that accepts text descriptions, audio recordings, photos, video, and OBD2 diagnostic codes as inputs and returns a list of possible vehicle issues along with general informational guidance.

By downloading, installing, or using CarEKG, you agree to these Terms of Service in full. If you do not agree, do not use the app.

CarEKG is not a professional diagnostic service. It is an informational tool.

Specifically:

• CarEKG does not replace a licensed mechanic or qualified automotive technician. Nothing this app produces should be treated as a professional mechanical diagnosis.
• AI-generated outputs may be incomplete, inaccurate, or incorrect. The diagnostic suggestions, safety assessments, repair guidance, parts recommendations, and related content provided by this app are generated by artificial intelligence and are subject to error. They reflect probable possibilities, not confirmed findings.
• You are solely responsible for all decisions you make regarding your vehicle. This includes decisions about whether to drive the vehicle, how to repair it, which parts to purchase, and whether to seek professional service.
• Do not rely on this app alone for any decision that affects safety. If you have any concern that your vehicle may be unsafe to operate, stop driving it and consult a licensed mechanic before making any safety-related decision.
• Repair guidance is provided for informational purposes only. If you choose to perform repairs based on information from this app, you do so entirely at your own risk. Vehicle repairs carry risk of injury, property damage, and death if performed incorrectly.

Nothing in this app constitutes professional automotive, mechanical, or safety advice.

You expressly acknowledge and agree that:

• Vehicle diagnostics and repair involve inherent risks, including but not limited to personal injury, death, and property damage.
• AI-assisted diagnostic tools, including CarEKG, cannot replicate a physical inspection by a trained mechanic and may miss conditions that would be apparent upon in-person inspection.
• You voluntarily assume all risks associated with your use of this app and any decisions or actions you take based on its outputs.
• Your use of any repair guidance, parts vendor links, YouTube videos, mechanic referrals, or other third-party content surfaced by this app is entirely at your own risk.

To the maximum extent permitted by applicable law:

EKG Diagnostics LLC and its owner, officers, and agents shall not be liable for any injury to persons or animals, death, property damage, vehicle damage, or any other loss or harm of any kind arising from or related to:

• Your use of or reliance on any diagnostic output, safety assessment, repair guidance, or other content generated by CarEKG;
• Any third-party content, videos, parts vendors, or mechanic referrals surfaced through CarEKG;
• Any failure, inaccuracy, or incompleteness of AI-generated content;
• Any decision you make regarding whether to operate, repair, or service your vehicle.

In no event shall our total liability to you for any claim arising out of or related to this app exceed the amount you paid us in the twelve (12) months preceding the claim, or fifty dollars ($50.00), whichever is greater.

This limitation applies regardless of the legal theory under which a claim is brought (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.

You agree to defend, indemnify, and hold harmless EKG Diagnostics LLC and its owner, officers, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from:

• Your use of CarEKG;
• Your violation of these Terms;
• Any action you take, or fail to take, based on content provided by the app;
• Any injury, property damage, or other harm resulting from vehicle repairs or decisions you made in connection with your use of this app.

CarEKG surfaces content and links from third parties, including but not limited to:

• Automotive parts vendors
• YouTube videos
• Mechanic listings and referral links
• Web-sourced repair information

Affiliate Disclosure: CarEKG participates in the Amazon Associates affiliate program. When you purchase a product through an Amazon link in the app, EKG Diagnostics LLC may receive a commission at no additional cost to you. Links to other parts vendors, including AutoZone and O'Reilly Auto Parts, are provided for your convenience only and are not affiliate links — CarEKG earns no commission from them. Affiliate links are provided because the parts or products are relevant to your diagnostic results — not because of the commission relationship. We do not recommend parts or vendors solely on the basis of affiliate compensation.

We do not control, endorse, verify, or warrant the quality, accuracy, or fitness of any third-party products, parts, or content. Your purchase decisions and interactions with third-party vendors are solely between you and those parties. We are not responsible for any loss, injury, or harm resulting from parts purchased or content accessed through the app.

CarEKG offers the following access tiers:

• Free Tier ($0): Three (3) diagnostic preview credits granted at signup. No payment required.
• Repair Pass ($4.99, one-time): A single one-time payment that provides 14 days of full access to all solution content. This is not a subscription and does not auto-renew.
• Pro Monthly ($9.99/month): A recurring monthly subscription providing full access to all solution content. Renews automatically each month until cancelled.
• Pro Annual ($79.99/year): A recurring annual subscription providing full access to all solution content. Renews automatically each year until cancelled.

Billing and Cancellation:

• Subscriptions (Pro Monthly and Pro Annual) renew automatically unless cancelled before the renewal date.
• You may cancel at any time through your Google Play account settings. Cancellation takes effect at the end of the current billing period.
• The Repair Pass is a one-time purchase and is not subject to recurring charges.
• We do not offer refunds for partial billing periods except where required by applicable law.
• We reserve the right to change subscription pricing with reasonable advance notice.

You agree not to use CarEKG to:

• Submit false, fabricated, or misleading vehicle information with the intent to manipulate diagnostic outputs;
• Attempt to reverse-engineer, scrape, or extract the app's AI systems or proprietary content;
• Use the app for any unlawful purpose;
• Resell, sublicense, or commercially redistribute app content without our written consent.

All content, AI systems, user interfaces, branding, and technology within CarEKG are the property of EKG Diagnostics LLC or its licensors and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial purposes only.

Your use of CarEKG is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the app, you consent to our data practices as described in the Privacy Policy, available at carekg.app/privacy.

We may update these Terms from time to time. When we do, we will update the “Last Updated” date at the top. If changes are material, we will notify you within the app. Your continued use of CarEKG after any update constitutes your acceptance of the revised Terms.

These Terms are governed by the laws of the State of Oregon, United States, without regard to its conflict of law principles.

Any dispute arising from these Terms or your use of CarEKG that cannot be resolved informally shall be submitted to binding arbitration under the rules of the American Arbitration Association, conducted in Washington County, Oregon. You waive any right to participate in a class action lawsuit or class-wide arbitration against us.

Nothing in this section prevents either party from seeking emergency injunctive relief in a court of competent jurisdiction.

If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force and effect.

These Terms, together with the Privacy Policy, constitute the entire agreement between you and EKG Diagnostics LLC regarding your use of CarEKG and supersede all prior agreements or understandings on this subject.
